Terms and Conditions

Commercial Terms

It is the responsibility of the client to own and understand the plans, Business Planner UK Ltd will explain the workings of the model to the clients but the understanding of the business operation being modelled is the sole responsibility of the client.


The information and plans provided are produced based on the customer’s requests and assumptions based on those requests. The responsibility for checking the accuracy and relevance of information lies with the clients and Business Planner UK Ltd cannot be held accountable for any data held within the plans.

The client is responsible for providing the industry background, product idea, market research, operational processes, competitor information and sales forecasts (collectively known as the “business venture”). Business Planner UK Ltd then has the responsibility to model and collate this information into a viable commercial plan.


For templates to third parties, Business Planner UK Ltd will provide financial information only and only in excel format, any additional third-party information requirements are the responsibility of the client.


Once the Client has received the draft business plan, Business Planner UK Ltd will complete three sets of revisions or changes to the draft business plan, so long as these changes are requested within 28 days. After this period Business Planner UK Ltd will charge an hourly fee (£75 per hour) for its services.
 

Where a deposit is paid

 

This deposit is paid in recognition of the fact the client has a viable business venture to be modelled. Business Planner UK Ltd may assist in the formulation of the business venture, but if no credible venture is forthcoming them there is no right to refund.

Business Planner UK Ltd, may at its discretion offer a refund if no credible business venture is forthcoming, after taking into account time spent analysing the client’s solutions (To be billed per hour (min 1 hour at the rate of £75 per hour)).

If no credible client business venture is provided by the client after 6 hour’s of Business Planner UK Ltd worked time, then Business Planner UK Ltd has the right to terminate the agreement and refund the deposit less then cost of the time incurred (6 x £75 = £450).

 

Where there are two stage payments, the second stage is only payable on

 

Completion of the Business Plans

– or --

Granting of a place on an Endorsement body mentoring scheme

 

If the Visa is subsequently not issued, a refund of the second part is only provided, at the discretion of Business Planner UK Ltd, and then only if the Visa refusal is as a result in a fault in the business plan provided by Business Planner UK Ltd.

Terms and Conditions

 

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of a client and Business Planner UK Ltd concerning our access to and use of the BusinessPlannerUK.com website as well as any other media form, media channel, mobile website or mobile a application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. I you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.

You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.

TERMS & CONDITIONS OF SALE

Fees quoted are for the services set out. Any changes made at the Client's request may result in revised quotations.

The agreed fees will be invoiced as follows: 100% at inception of project - unless expressly changed in invoice

Where the execution of the contract involves any payment in foreign currency by Business Planner UK Ltd., all costs quoted are subject to alteration in the light of any changes in the relevant currency exchange rates.

Business Planner UK Ltd reserves the right to decline to proceed with a project until the Client has paid in full the initial invoice.

The Client shall indemnify Business Planner UK Ltd against all claims, proceedings and liabilities (whether civil or criminal) of any kind whatsoever which may arise in consequence of the use, demonstration or consumption by any person of any goods or services supplied by the Company (or his/her servants or agents) for the purposes of the business plan, and against all legal costs fees and expenses incurred in relation to any such claims, proceedings or liabilities.

Business Planner UK Ltd will use its best endeavour to ensure the accuracy of reports or tabulations provided to the Client but does not warrant the accuracy of the data provided. In the event of an error caused by the negligence of Business Planner UK Ltd in any reports or tabulations, the Company will take all reasonable steps to correct the error at its own expense, but will not be liable for any damage or loss caused to the Client or any other person by the error. The research and writing of the business plan will be carried out in a professional manner but the nature of this type of work requires the collection of data from original sources, which may be incomplete, inconsistent or inaccurate.

In advising or making recommendations to the Client in connection with business strategy and/or methods, Business Planner UK Ltd will act in good faith and do no more than suggest steps the Client might sensibly take and will not be liable for any damage or loss suffered by the Client in reliance upon any such advice and/or recommendations.

No variation of the contract between the Client and Business Planner UK Ltd  shall be effective unless and until confirmed in writing by a director on behalf of the Company.
